Privacy Policy.

What personal data we collect on this site, why, who sees it and what you can do about it. Plain language, no tricks.

1. Who we are

This site is run by Brandon Kesler, doing business as CABOONE Luxury Real Estate (“CABOONE”, “we”, “us”), brokered by House of Baja Realty. We are responsible for your personal data (the “controller”, or responsable under Mexican law).

2. What we collect

What you give us, plus technical and usage data needed to run, protect and improve the site.

Contact formsName, WhatsApp or phone number, email (optional), how you found us, what you're looking for and anything you write in the message.

Showing requestsThe same, plus the home you're asking about and your preferred dates.

Home valuationThe same, plus the community your home is in and when you'd like to sell.

WhatsApp, email, phoneYour number or address, name and whatever you send us in the conversation.

Technical dataIP address, browser and device type, pages requested and timestamps, kept in server logs and used by Google reCAPTCHA to tell people from bots.

Usage dataPages you visit, how you got here, and clicks on WhatsApp, call and email links, collected through Google Analytics and the Meta Pixel (see section 5).

Please don't send sensitive data such as health information, government ID numbers, or bank or card details through this site. Documents for a purchase or sale are exchanged directly with Brandon's team, not through the site.

3. Why we use it

To answer you: contact you on WhatsApp, phone or email about the homes, showings, valuation or financing you asked about.
To help you buy or sell: arrange showings, prepare a valuation, and work with you, the other party and the brokerage through to closing.
To understand and improve the site: see which pages and listings people use and which of our ads and videos bring visitors.
Advertising: measure our Facebook and Instagram ads and show them to people who visited the site.
To protect the site: block spam and abuse and keep the site secure.
Legal duties: keep the records Mexican tax, real estate and anti-money-laundering rules require.

Analytics and advertising are secondary purposes. You can say no to them at any time (see section 5) or by writing to info@caboone.com, and it won't affect how we answer you.

Where the law asks for a legal basis, we rely on your consent (forms, analytics and advertising), on steps toward a contract you asked for (showings, valuations, a purchase or sale), on our legitimate interest in keeping the site safe, and on legal obligations.

4. Who sees it

We don't sell your personal data. It is seen only by:

Brandon and his team, who answer your request. New requests reach the team through a private Telegram chat, WhatsApp and email.
House of Baja Realty, our brokerage, and, once you move ahead with a deal, the people needed to close it, such as the other party's agent, the notary and the escrow company.
Service providers who work for us on our instructions: website hosting (Fly.io), email, Telegram and WhatsApp (Meta).
Google, which runs reCAPTCHA, Google Analytics and the site's fonts. Google's Privacy Policy and Terms apply to them.
OpenStreetMap, which shows the maps on the contact page and on property pages and sees your internet address when a map loads. The OpenStreetMap Foundation's Privacy Policy applies.
Meta, which runs the Meta Pixel for Facebook and Instagram ads, under Meta's Privacy Policy.
Authorities, when the law or a valid legal order requires it.

Some of these providers are in the United States or other countries outside Mexico, so your data may be processed there. Sharing with them is needed to answer you and run the site, and we use providers that protect it with appropriate safeguards.

5. Cookies, analytics and ads

The site uses a few cookies to work. Google Analytics and the Meta Pixel load only if you accept them in the cookie banner:

Form securityA cookie that protects the forms against forged submissions.

LanguageA cookie that remembers the language you picked for the site.

Google reCAPTCHAOn pages with a form, Google may set cookies and read device information to tell people from bots.

Google AnalyticsCounts visits and shows which pages are used. We don't send Google your name, phone or email.

Meta PixelTells Meta that a visit, a contact click or a form submission came from our ads, so we can measure and target them.

You can block or delete cookies in your browser, install the Google Analytics opt-out add-on, and change your ad settings on Facebook and Google. Details are in our Cookie Policy.

6. Links

This site links to YouTube, Instagram, Facebook, WhatsApp and OpenStreetMap. When you click through, those services handle your data under their own policies.

7. How long we keep it

Requests that don't lead to a deal: up to 24 months, then deleted.
Clients: for the relationship, plus as long as Mexican tax, real estate and commercial law requires us to keep records.
Analytics: Google Analytics keeps visit data for up to 14 months.
Server logs: a few weeks, unless needed to look into abuse.

8. Your rights

You can ask us to:

Access the personal data we hold about you;
Rectify it if it's wrong or incomplete;
Cancel (delete) it when we no longer need it;
Oppose its use for a specific purpose, such as analytics or advertising;
Revoke your consent, or limit how we use or share your data.

These are your ARCO rights under Mexico's Federal Law on the Protection of Personal Data Held by Private Parties. If you live in the EU, the UK, Canada or a US state with a privacy law such as California, you may have similar rights, including data portability and opting out of targeted advertising.

To use any of them, email info@caboone.com with your name, how to reach you, what you're asking for and, if needed, something that lets us confirm it's you. We reply within 20 business days. If you think we haven't handled your data properly, you can complain to the data protection authority where you live.

9. Security

We protect your data with encrypted connections, password-protected admin access limited to the people who need it, and providers with their own security programs. No system is perfectly secure; if a breach affects you, we'll tell you.

10. Children

This site is for adults buying or selling property. We don't knowingly collect data from anyone under 18. If you think a minor has sent us data, write to us and we'll delete it.

11. Changes

If we change this policy, we'll post the new version here with a new “Last updated” date.
